Terms of Service

By accessing or using Buildly("the platform", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

We may update these terms at any time. Continued use after changes constitutes acceptance. We will notify registered users of material changes by email.

You must be at least 13 years old to use Buildly. By using the platform you represent that you meet this requirement. If you are using the platform on behalf of an organization, you represent that you have authority to bind that organization to these terms.

You are responsible for maintaining the security of your account credentials. You must not share your account or allow others to use it. You are responsible for all activity that occurs under your account.

We may suspend or terminate your account if we believe you have violated these terms, without prior notice in serious cases.

You agree not to use Buildly to:

• Generate content that is illegal, harmful, abusive, or violates the rights of others
• Produce spam, phishing content, or deceptive materials
• Attempt to bypass rate limits, access controls, or security measures
• Reverse engineer, scrape, or systematically download platform content
• Impersonate another person or entity
• Violate any applicable law or regulation
• Infringe the intellectual property rights of others

We reserve the right to remove any content and suspend any account that we determine, at our sole discretion, violates these terms or harms the platform or its users.

Tool outputs are generated by AI and may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing any AI-generated content before using it. Buildly makes no warranties about the accuracy, reliability, or fitness for purpose of AI outputs.

We do not claim ownership of content you input into tools or content that tools generate for you. You retain ownership of your inputs. You grant us a limited license to process your inputs for the purpose of providing the service.

If you publish tools on Buildly as a developer, you agree that:

• You own or have the right to publish the tool and its underlying system prompt
• Your tool complies with our acceptable use policy
• You are responsible for the outputs your tool generates
• We may remove tools that violate these terms or our policies
• For paid tools, we process payments and remit earnings minus our platform fee per the current fee schedule

API access is subject to rate limits based on your plan. Automated or bulk use that exceeds fair-use thresholds may result in rate limiting or account suspension. You must not use the API to build a competing service that re-sells access to Buildly tools without our written permission.

Pro plan subscriptions are billed monthly or annually. All prices are in USD. Payments are processed by Stripe and are non-refundable except where required by law. If you cancel, your Pro access continues until the end of the current billing period.

Paid tool purchases (per-run fees) are non-refundable once the run has completed and a result has been returned.

We may change pricing at any time. We will notify existing subscribers 30 days before any price increase takes effect.

Buildly and its logos, design, and original content are owned by us and protected by intellectual property law. You may not reproduce, distribute, or create derivative works from our platform without our written permission.

Developer system prompts are the intellectual property of the developer who created them. We protect prompts by never exposing them to end-users via the API or tool detail pages.

The platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that AI outputs will be accurate or suitable for any purpose.

To the maximum extent permitted by law, Buildly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the platform. Our total liability to you for any claims arising from these terms or your use of the platform shall not exceed the amount you paid us in the 12 months prior to the claim.

You may close your account at any time by contacting us. We may terminate or suspend your account immediately if you breach these terms. Upon termination, your right to use the platform ceases and we may delete your data subject to our retention policy.

These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the platform shall be resolved through good-faith negotiation, and if unsuccessful, through binding arbitration.
